Our trading terms
Terms of Trade
All goods and services are owed in full on receipt, if on account then all goods and services are payable prior to the 20th of the month following the invoice. Morley Motorcycle & Marine shall retain ownership of everything supplied to or on behalf of the account holder (referred to as customer) until it has been paid for in full.
In the event of non payment for whatever reason we reserve the right to close the account and conduct business on a "cash only" basis. The customer shall agree to pay all expenses in respect of recovery of any debt.
Privacy Policy
Morley Motorcycle and Marine do not sell or rent your personal identification to third parties, except where legislation requires.
We release account and other personal information only when we believe release is appropriate to comply with law; enforce or apply our terms and conditions; or protect the rights, property, or safety of Morley Motorcycle and Marine, our users, or others.
We protect your credit card information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input.
Your credit card details are not held on computer or file.
Backorders
Where an item is ordered and not available at the distribution center and is requested to be put on backorder (procured from overseas) then a 50% deposit is required before the item is ordered.
Backordered items are non returnable and non refundable.
If you wish to cancel a backordered item you must do so before 10.00am the following day that the backorder was placed.
Returns Policy
Items for return will not be accepted under any conditions after 14 days from the date of sale.
Items for return will not be accepted if the item has been fitted or the item or packaging is damaged.
Electrical or electronic items will not be accepted for return.
Sale items or special priced items will not be accepted for return.
Freight on returned items is at your (the customer) expense.
You may be charged a return fee of $6.00 per invoice. (This charge may be wavered if the part has been supplied incorrectly by Morley Motorcycle and Marine or the item was not true to label.)
Liability and Maintenance Guarantee
The buyer shall ensure that the goods ordered are fit and suitable for which they are required and Morley Motorcycle & Marine are under no liability if they are not.
In the case of goods not of our own manufacture the buyer is entitled to only such benefits as Morley Motorcycle & Marine may receive under any guarantee given to Morley Motorcycle & Marine by the manufacturers in respect thereof. Morley Motorcycle & Marine shall not be liable for consequential or special damages under any circumstances whatsoever.
In lieu of any warranty, condition, or liability implied by law, Morley Motorcycle & Marine's liability in respect of any defect in or failure of the goods supplied, or for any loss, injury or damage attributable thereto, is limited to making good the replacement or repair of defects arising under normal property use and maintenance arising solely from faulty design, materials, or workmanship within the guarantee period, if stated, provided always that such defective parts are promptly returned to the seller, unless otherwise arranged. At the termination of the appropriate period all liability on Morley Motorcycle & Marine's part ceases.
This warranty does not cover damage from misuse, accident, neglect or improper operation, maintenance, installation, modification or adjustment.
Morley Motorcycle & Marine liability under this contract and the warranty in this clause is confined to the buyer named in this contract, it being agreed that Morley Motorcycle & Marine has no liability to any purchaser of the goods from the buyer in that the buyer's rights under this contract are not assignable without the prior written consent of Morley Motorcycle & Marine.
Disputes
In the event that any part of an invoice is disputed, the amount not under question shall be paid promptly according to applicable payment terms. Any claim or dispute arising hereunder shall be subject to arbitration in accordance with the Arbitration Act (1996) of New Zealand.
